Terms of Use

Last updated October 22, 2026

By pressing Play you agree to these terms and our Privacy Policy. They are short on purpose.

Agreeing to these terms

These terms are an agreement between you and Cruz Labs LLC. The play screen says “By pressing Play you agree to the Terms and Privacy Policy”, and pressing Play (or otherwise using the game) means you accept them. If you do not agree, please do not play. They take effect on October 22, 2026.

Who can play

You must be at least 13 to play. If you are under 18, you need a parent or guardian’s OK, and they agree to these terms for you.

A free game

Fourth and Miles is a free daily game run by Cruz Labs LLC. You do not need an account to play. We may change, pause or retire any part of the game at any time.

Your licence to play

We give you a personal, non-commercial, non-exclusive, non-transferable licence to play the game and view its content in your browser, which we can take back if you break these terms. Everything not given to you here stays with us.

What you may not do

  • Do not scrape, crawl or bulk-download questions, answers, chirps, audio, art or map data from the site or its APIs.
  • Do not use bots or scripts to play, to submit guesses, or to put unusual load on the service.
  • Do not use the game’s content to train, fine-tune or test an AI or machine-learning model, or to build a dataset for one.
  • Do not try to break, probe or get around the site’s security or limits.
  • Do not click ads you are not interested in, or create fake ad views or clicks.
  • Do not copy the game, its content or its look for a competing product.
  • Do not use the game for anything unlawful.

Sharing your results

You are welcome to share your score, share card and share text anywhere: group chats, social posts, message boards. What you post is yours. We do not host it, so you grant us nothing by sharing it, and you are responsible for where you post it. Please do not present the game’s questions or chirps as your own work, republish the daily answers in bulk, or edit the share text to mislead people about what the game is.

Chirps

The finale’s chirps are banter about programs, traditions and fan bases, never about individual people. They are jokes, not statements of fact. Spicy mode is off by default: it has more attitude and is meant for adults, and it only turns on if you choose to switch it on. It still has no slurs and no jokes about individual people. If a line misses the mark, report it through the contact page and we will look at it.

Our content, and AI-generated audio and art

The game’s questions, writing, design and code belong to Cruz Labs LLC or its licensors. Some audio and art is made with AI tools; it may not be protected by copyright, and we claim only the rights the law gives us in it, but please do not lift it in bulk either. Map data and other open data are used under their own licences; see the About page for credits.

School names and trademarks

University names, team names, nicknames and other marks belong to their owners. Fourth and Miles uses school names only as plain text, nominatively, to identify the programs a question is about, with no logos. Fourth and Miles is not affiliated with, endorsed by or sponsored by any university, athletic conference, the NCAA or the College Football Playoff.

Links and ads

The game links to other sites and may show ads from third parties. We do not control those sites or ads and are not responsible for their content, products or privacy practices. Your dealings with them are between you and them.

No warranty

The game is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose and non-infringement. We work to get every fact right, but questions, answers, scores and stadium locations may contain mistakes, and the game may be unavailable at times.

Limits on our liability

To the fullest extent the law allows, Cruz Labs LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the game. Our total liability for any claim about the game is limited to US $100. The game is free; this cap reflects that. Some places do not allow these limits, so they may not all apply to you.

If you misuse the game

If you break these terms or misuse the game (for example by scraping it or attacking the service) and someone makes a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim, including reasonable legal fees.

Ending access

We may block or limit anyone’s access to the game, without notice, if they break these terms or abuse the service. You can stop playing at any time. The sections on our content, no warranty, liability limits, misuse and disputes still apply after that.

If something goes wrong

Please email us first at hello@fourthandmiles.com and tell us what happened and what you would like us to do. We will both try in good faith to sort it out within 30 days, and neither of us will go to court before then.

Governing law and where disputes go

These terms are governed by the laws of [STATE / COUNTRY TO BE CONFIRMED], without regard to conflict-of-law rules. If the email step does not settle a dispute, it goes exclusively to the state or federal courts located in [COUNTY, STATE TO BE CONFIRMED], except that either of us may bring a claim in small-claims court where you live if it qualifies. There is no arbitration clause and no class-action waiver in these terms. Nothing in these terms limits rights you have under the consumer laws of the place you live.

The rest of the fine print

If a court finds part of these terms unenforceable, the rest still applies. These terms and the Privacy Policy are the whole agreement between you and us about the game. If we do not enforce a term right away, we have not given it up.

Changes

We may update these terms. The date at the top shows the latest version, and we will flag big changes on the site. Continuing to play after a change takes effect means you accept it.
